While there is color variation amongst European Garden Spiders, their one distinct marking is the cross pattern on their abdomen's top side. This looks like it might be some sort of Marbled Orb Weaver.

definately not a european garden spider, looks more like mebbe some kind of crab spider? But not a garden spider, the markings are all wrong for this
